This regulation is part of our conditions of use. By opening an account on HOGO Places, you agree to these terms and conditions of use.
1. General
1.1 These Conditions govern the conditions of access to this Website and the services offered (the "Service") and their conditions of use. By using this Service, you agree to be bound by these Terms. If you do not wish to be bound by these Terms, do not use this service and / or do not register.
1.2 In these Terms and Conditions, the terms "HOGO Places", "we" and "our" refer to HOGO Places and its employees, directors, affiliates, successors and assigns. HOGO Places is a product of HOGO Market, registered in Quebec/Canada.
1.3 The terms "you" and "your" refer to any user of HOGO Places.
1.4 These Terms and Conditions came into effect on July 14, 2018. These Terms and Conditions may be subject to an update.
1.5 Governing Law: This Agreement is governed by Canadian law and the parties submit to the exclusive jurisdiction of Canadian courts.
1.6 No waiver: The failure of HOGO Places in the exercise or application of any right or provision of these Terms does not constitute a waiver of such right or provision.
1.7 Change: We may change these Terms and Conditions at any time without notice, except to the extent provided by law. You can check the latest version of these conditions at any time on this site. You may terminate your use of the Service if you dispute a change. If you use the Service after the effective date of a change, you are deemed to have accepted this change. You agree not to modify these Terms, and you acknowledge that any attempt by you to modify these Terms will improve.
1.8 Full agreement: This agreement constitutes the entire agreement between the parties and replaces any agreement or contract covering the subject of this contract.
1.9 Severability
If any provision of these Terms should be found invalid by a court or competent arbitrator, the parties nevertheless agree that the arbitrator or court should endeavor to implement the intentions reflected in the provision of the Terms, and other provisions in force.

These sites are in no way controlled by HOGO Places and we are not responsible for the accuracy, completeness, legality or any other aspect of these sites, including the content. You access these sites at your own risk.
2.Listing content
2.1 You must accurately describe, in the About section, each person involved in the manufacture of an item in your shop.
2.2 You are using your own photos - not photos from image banks, artwork of your article, or photos used by other sellers or other sites.
2.3.1 If you use third-party photos / images, you must ensure that they are royalty-free
2.4 If you sell custom items in the handmade category, you agree that:
2.5 All cards produced from custom items are available for purchase.
2.6 Each product sheet of a custom order has a fixed price.
2.7 You alone are responsible for Your Content, and once posted to HOGO Places, it cannot always be withdrawn.
You assume all risks associated with Your Content, including anyone’s reliance on its quality, accuracy, or reliability, and any risks associated with personal information you disclose.
You represent that you own or have the necessary permissions to use and authorize the use of Your Content as described herein.
You may not imply that Your Content is in any way sponsored or endorsed by HOGO Places.
You may expose yourself to liability if, for example, Your Content contains material that is false, intentionally misleading, or defamatory; violates any third-party right, including any copyright, trademark, service mark, patent, trade secret, moral right, privacy right, right of publicity, or any other intellectual property or proprietary right; contains material that is unlawful, including illegal hate speech or pornography; exploits or otherwise harms minors; violates or advocates the violation of any law or regulation; or violates these Terms.
2.8 We may use Your Content in a number of different ways, including by publicly displaying it, reformatting it, incorporating it into advertisements and other works, creating derivative works from it, promoting it, distributing it, and allowing others to do the same in connection with their own websites and media platforms (“Other Media”).
As such, you hereby irrevocably grant us world-wide, perpetual, non-exclusive, royalty-free, assignable, sublicensable, transferable rights to use Your Content for any purpose.
Please note that you also irrevocably grant the users of the Service and any Other Media the right to access Your Content in connection with their use of the Service and any Other Media.
Finally, you irrevocably waive, and cause to be waived, against HOGO Places and its users any claims and assertions of moral rights or attribution with respect to Your Content.
By “use” we mean use, copy, publicly perform and display, reproduce, distribute, modify, translate, remove, analyze, commercialize, and prepare derivative works of Your Content.
2.9 As between you and HOGO Places, you own Your Content.
We own the HOGO Places Content, including but not limited to visual interfaces, interactive features, graphics, design, compilation (including, but not limited to, our selection, coordination, aggregation, and arrangement of User Content and other Service Content), computer code, products, software, aggregate star ratings, and all other elements and components of the Service excluding Your Content, User Content and Third Party Content.
We also own the copyrights, trademarks, service marks, trade names, trade secrets, and other intellectual and proprietary rights throughout the world associated with the HOGO Places Content and the Service, which are protected by copyright, trade dress, patent, trademark, and trade secret laws and all other applicable intellectual and proprietary rights and laws.
As such, you may not sell, license, copy, publish, modify, reproduce, distribute, create derivative works or adaptations of, publicly display or in any way use or exploit any of the HOGO Places Content in whole or in part except as expressly authorized by us.
Except as expressly and unambiguously provided herein, we do not grant you any express or implied rights, and all rights in and to the Service and the HOGO Places Content are retained by us.
2.10 HOGO Places and its licensees may publicly display advertisements, paid content, and other information nearby or in association with Your Content.
You are not entitled to any compensation for such advertisements. The manner, mode and extent of such advertising are subject to change without specific notice to you
2.11 User Content (including any that may have been created by users employed or contracted by HOGO Places) does not necessarily reflect the opinion of HOGO Places.
Except as required by law, we have no obligation to retain or provide you with copies of Your Content, and we do not guarantee any confidentiality with respect to Your Content.
2.12 Except as required by law, we reserve the right to screen, remove, edit, or reinstate User Content at our sole discretion for any reason or no reason, and without notice to you.
For example, we may remove a review if we believe that it violates our Guidelines.
3. Transparently represent yourself, your profile and your listings
Transparency is an important value for HOGO Places. Transparency is about representing yourself honestly and accurately about yourself, your articles and your business.
By listing on HOGO Places, you agree that you:
3.1 Provide honest and accurate information in your listing.
3.2 Honor your general conditions.
3.3 Exactly represent your listings in content and photos of them.
3.4 Respect the intellectual property of others.
If you believe that someone has infringed your intellectual property rights, you can report it to HOGO Places.
3.6 Do not create duplicate listings.
4. Privacy and protection of personal information
You are responsible for protecting the personal information of members you receive or process, and for complying with all applicable legal obligations.
This includes the existing privacy and data protection laws that govern the way in which
which you can use information belonging to a user of HOGO Places.
These laws may require you to publish and respect your own privacy policy, which must be available to HOGO Places users with whom you are communicating and consistent with this policy and HOGO Places Terms of Service.
5. Create and download content
As a member of HOGO Places, you have the ability to create and download various types of content, such as listings, conversations, text, photos, and videos.
To ensure security and respect within our community, you agree not to download content:
➢ Abusive, threatening, defamatory, considered harassment
➢ Obscene or vulgar;
➢ Which constitutes a violation of the privacy of another person;
or
➢ False, misleading or deceitful.
6. Build a strong reputation through our notification system
Reviews are a good way to build a reputation in HOGO Places.
Users can leave a review, along with a one-to-five star rating and a photo service's usage proof.
If you receive an unfavorable opinion, you can contact the user or, if the review is less than 3 stars, post a reply.
Notices and your response to notices can not:
➢ Contain private information;
➢ Contain obscene, racist or harassing images or language;
➢ Contain claims of prohibited medicinal substances;
➢ Contain advertising or spam;
➢ Concerning things beyond the control of the owner, such as the carrier, HOGO Places or a third party; or
➢ To undermine the integrity of the notice system.
6. Proxy scam
Counterfeit scam is strictly prohibited on HOGO Places. Counterfeit scam is fraudulently increasing the reputation of a store by using another account.
The purpose of the scam by proxy is to make a seller more attractive by increasing the number of sales of his shop and the overall score of reviews.
Not only does this violate our fundamental value of transparency. Notices must reflect the user's experience or honest and impartial opinions, conclusions and beliefs.
7. Offer excellent customer service
We expect our listing's owner to offer high-end customer service. By listing on the HOGO Places, you agree to:
7.1 Respond to conversations in a timely manner.
7.2 Resolve disagreements or conflicts directly with the user. If you do not reach a resolution, our dispute resolution team can help you with our litigation system.
8. Obligations
By listing on HOGO Places, you accept :
8.1 Do not access or attempt to use it if you are under 18 years of age and do not have the legal capacity to contract in the territory concerned;
8.2 Provide truthful, accurate, current and complete evidence of your identity and update them as they change;
8.3 To provide us with truthful information during your payment transactions;
8.4 Do not provide false or misleading information;
8.5 Do not allow any third party to access your registration information;
8.6 Do not refuse to confirm any information you provide or refuse to cooperate during an investigation;
8.7 Do not use an anonymizer proxy, use a tool such as a robot or a manual process to scan or monitor this platform.
10. Complaints
To make a complaint about the HOGO Places service, please send an email to "Contact Us" or email .
We will acknowledge receipt of your complaint within two business days. We will investigate and report the results of our investigation within seven business days of receiving your request.
11.Security
HOGO Places takes security very seriously. We do our best to use advanced technologies to keep your information and transactions secure.
If you know a person or entity If you receive an email supposed to come from HOGO Places, first check the last part of the sender, it should end with "@ hogoplaces.com" but if you suspect a phishing scam , please and transfer or send using this email using the contact form or email 'support@hogoplaces.com'.
12. Responsibility and content buyers:
HOGO Places makes every effort to ensure the accuracy and updating of the information published on the Site. HOGO Places reserves the right to correct at any time and without notice the content of the Site. However, HOGO Places can not guarantee the accuracy, precision, updating or completeness of the information made available on the Site.
Comments, Reviews, ratings, suggestions, ideas, recipes, graphics, photos or other information provided to HOGO Places through the Blog, Reviews and social media such as Facebook are confidential. By posting content on our media, you grant HOGO Places a perpetual license and right, irrevocable, royalty-free and transferable license to use, copy, modify, delete in its entirety or in part, adapt , publish, translate, sell and distribute such content and to create derivative works or to incorporate it in any form, media or technology throughout the world without compensation to you and without mentioning the source .
The user agrees to be responsible for all content published on the Site and on social networks. This means that the user, not HOGO Places, is fully responsible for the content it publishes, including appropriateness, legality, originality, reliability and copyright relating thereto.
We may reject or remove the contents of a user without notice. However, we are under no obligation to monitor the User Content and you agree that we are not responsible for the User Content, or for any loss and any damage resulting.
13. Prohibited products
Certain products or services are not authorized on the site (non-exhaustive list):
Tobacco, drugs and associated objects, dangerous and illicit substances
Cosmetics, medicine and parapharmacy
Combat or self-defense bladed weapons, firearms, explosives, hunting traps
Adult content (pornography, nudity, etc.)
Certain plant and animal species protected, threatened or taken from their natural environment
Certain parts or products derived from threatened and/or protected wild species, such as ivory
Consigned items
Call for private or humanitarian financial donations
Offers that could lead to biased practices
Notice of search for a person
The majority of consumer products from industrial manufacturing
Slimming product, food supplement or presented as miraculous
Counterfeit product
Product bearing protected emblems
Product or services infringing intellectual property rights
Offering illegal services or jobs
14. Termination
Each party may terminate these terms and conditions by written notification prior to a date.
We may terminate these terms if we discover that :
you violate any provision of these terms;
you use the platform deleteriously for other customers or we believe you are committing an act capable of discrediting HOGO Places;
you are attempting to violate the security of the platform (even attempting to use unauthorized identifiers).
